Customers are encouraged to read them carefully before placing any order or engaging with our business, as they outline your rights, responsibilities, and the legal framework applicable to all dealings. GENERAL TERMS AND APPLICABLE LAW

These Terms and Conditions govern all quotations, sales, and supply of products and services by Sparesly (Pty) Ltd. By placing an order or using our website, you agree to be bound by these Terms and Conditions.

All transactions are subject to the laws of the Republic of South Africa, including but not limited to:

  • The Consumer Protection Act 68 of 2008 (CPA)

  • The Protection of Personal Information Act 4 of 2013 (POPIA)

  • The Electronic Communications and Transactions Act 25 of 2002 (ECTA)

In the event of any dispute, the parties agree that South African law shall apply, and any legal proceedings shall be subject to the jurisdiction of the courts of South Africa.

Quotations are valid for the period stated therein. Prices are subject to change without prior notice unless confirmed in writing. All goods remain the property of Sparesly (Pty) Ltd until paid for in full.

ORDERS, DELIVERY, RETURNS AND REFUND POLICY

Orders are only confirmed once accepted in writing or upon issuance of an invoice by Sparesly (Pty) Ltd. Customers are responsible for ensuring that all product specifications, quantities, and technical requirements are correct at the time of order.

Delivery times are estimates and may vary depending on supplier availability and logistics. Sparesly (Pty) Ltd shall not be held liable for delays beyond its reasonable control.

Returns Policy

Returns will only be accepted under the following conditions:

  • The product is returned within 7 days of delivery (unless otherwise required under the CPA).

  • The product is unused, undamaged, and in its original packaging.

  • The return is accompanied by proof of purchase.

Custom-ordered, specially sourced, or non-stock items may not be eligible for return unless defective.

Refund Policy

Refunds will be processed once the returned goods have been inspected and approved. Approved refunds may be subject to a reasonable handling or restocking fee where applicable. Refunds will be processed via the original method of payment unless otherwise agreed.

In accordance with the Consumer Protection Act, customers are entitled to repair, replacement, or refund for defective goods within six (6) months of purchase, subject to the provisions of the Act.

LIMITATION OF LIABILITY AND USE OF PRODUCTS

All products supplied by Sparesly (Pty) Ltd are intended for industrial and commercial use. It is the responsibility of the customer to ensure that products are suitable for their intended application.

Sparesly (Pty) Ltd shall not be liable for:

  • Indirect or consequential damages

  • Loss of profits, production downtime, or business interruption

  • Improper installation, misuse, or modification of products

Liability, where applicable, shall not exceed the value of the goods supplied.

Sparesly (Pty) Ltd reserves the right to amend these Terms and Conditions at any time. Updated versions will be published on our website and shall take effect upon publication.
